US opens tariff refunds portal after court struck down Trump duties

The U.S. government has opened a portal for refunding over $166 billion in[2D[K
in revenue from tariffs imposed by President Donald Trump and subsequently [K
struck down by the Supreme Court. This move comes as part of the Biden admi[4D[K
administration's effort to help American businesses and consumers who were [K
negatively impacted by these duties.
The Trump administration had imposed tariffs on imported goods as part of i[1D[K
its 'America First' policy, but many of these duties were later overturned [K
or reduced by courts or international trade organizations. In July 2021, th[2D[K
the Supreme Court ruled that the Trump administration had exceeded its auth[4D[K
authority when it imposed tariffs on steel and aluminum imports from severa[6D[K
several countries.
Now that this ruling has been made final, businesses can apply for refunds [K
through a new online portal established by the U.S. Customs and Border Prot[4D[K
Protection (CBP). Eligible entities include importers who paid duties under[5D[K
under section 232 of the Trade Expansion Act or section 301 of the Trade Ac[2D[K
Act of 1974 between January 1, 2018, and June 1, 2020.
The CBP will begin processing claims immediately but requests must be submi[5D[K
submitted no later than one year after the final decision date for each cas[3D[K
case (which varies depending on when appeals are filed). It's worth noting [K
that while most affected businesses should qualify for full refunds minus a[1D[K
any applicable penalties or interest charges; individuals who paid duties a[1D[K
as part of personal purchases may not quality since they do not fall under [K
commercial importation guidelines set forth by law.
